Welcome to Binovanta ("we", "us", "our"). By creating an account or using any part of the Binovanta platform, websites, mobile experiences, APIs, or related services (collectively, the "Services"), you ("you", "user") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not create an account or use the Services.

1. Eligibility

You must be at least 18 years old and legally permitted to use online financial and trading services in your jurisdiction. You represent that all information you provide during registration and verification is accurate and complete, and you agree to keep it up to date.

2. Account Security

You are solely responsible for safeguarding your login credentials, two-factor authentication devices, and any wallet addresses or mobile money numbers you link to your account. You agree to notify us immediately of any unauthorized access. We are not liable for losses arising from your failure to protect your account.

3. Deposits, Withdrawals & Mobile Money

Deposits made through M-PESA (via PayHero) and other supported channels are credited to your real account balance once the transaction is confirmed by the payment provider. Withdrawal requests are processed to the M-PESA number or wallet address you provide. You are responsible for ensuring those destination details are correct; we cannot reverse a successfully processed transfer.

4. Trading Risk Disclosure

Trading digital assets, derivatives, and synthetic indices involves substantial risk and may result in the loss of all funds you commit. Past performance is not indicative of future results. You should only trade with funds you can afford to lose, and you should seek independent financial advice if needed. You acknowledge that you alone are responsible for your trading decisions and outcomes.

5. Bot Trading & Automation

Automation tools, signals, and AI-assisted strategies provided through the platform are informational. They do not guarantee profitable outcomes. You remain fully responsible for any positions opened by bots running under your account.

6. Demo Accounts

Demo accounts use virtual funds for practice and education only. Demo balances have no monetary value, cannot be withdrawn, transferred, or converted to real funds, and may be reset at any time.

7. Prohibited Activities

You agree not to use the Services for money laundering, fraud, market manipulation, unauthorized scraping, reverse engineering, or any activity that violates applicable law. We may suspend or terminate accounts that we reasonably suspect of violating these Terms.

8. KYC and Compliance

We may require identity verification (KYC) and source-of-funds documentation before processing deposits, withdrawals, or trades above certain thresholds. You agree to cooperate with such requests.

9. Fees

Trading, deposit, withdrawal, and payment-processor fees may apply and are disclosed at the point of transaction or on the platform fee schedule. We may update fees from time to time with reasonable notice.

10. Service Availability

We strive for continuous availability but do not guarantee uninterrupted access. We may suspend the Services for maintenance, security, regulatory, or operational reasons without liability.

11. Limitation of Liability

To the maximum extent permitted by law, Binovanta and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services.

12. Termination

We may suspend or terminate your account at any time for breach of these Terms, suspected fraud, regulatory requirements, or extended inactivity. You may close your account by contacting support after settling any outstanding balances.

13. Changes to These Terms

We may revise these Terms from time to time. Material changes will be notified through the platform or via email. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Binovanta operates, without regard to its conflict-of-law principles. Any disputes will be resolved in the competent courts of that jurisdiction.
